Laverne Boyd is the top vote getter

At the annual meeting yesterday Laverne Boyd was the top vote getter with 105 votes.

It seems hard to understand how Vern could have gotten more than twice the votes of the next board candidate but that's what happened.

Does this indicate dissatisfaction with the "New Era" board?

Bob Wartenbe tied with Donna Vargas for last place and resigned leaving Donna Vargas on the board.

So the new board is Laverne Boyd, Mark Carlton, Diane McAlpine, Donna Vargas and Richard Forbes in no particular order.

  1. The new Era board members gathered proxies from several homeowners and got onto the board in 2010. By signing a proxy, a homeowner gives the “proxy holder” the right to vote on their behalf. “Proxies” are also used to make a quorum for the annual meeting.

    As per California law CC SEC 1363.03-1363.09;

    A "Proxy" means a written authorization signed by a member or the authorized representative of the member that gives another member or members the power to vote on behalf of that member.

    This year for the 2012 election, new era board members gathered proxies from 12 homeowners. Each proxy then gives 5 additional votes to the person it’s given to.

    Of the 12 proxies, Diane McAlpine gathered 4 of them. This meant that in addition to her own 5 votes as a homeowner, with the proxies she now had 25 votes to cast as she pleased.

    Mark Carlton gathered 5 of the 12 proxies giving him 30 votes to cast.

    Donna Vargas gathered 3 proxies giving her 20 votes to cast.

    Board members Bob Wartenbe and Richard Forbes did not have any proxies.

    IMO, though this is a legal practice, it is highly unethical.

    The people spoke though, because Vern Boyd won the election with 101 votes. She did not gather any proxies, what do you think this indicates?

  2. I think I said what I think it indicates.

    As to the way the proxies and voting works on homeowners associations, it's weird. Not illegal. Unethical? Not if that's how it works. Should it be changed so it doesn't work that way?

    Probably......

    I don't think that is going to happen.
